Terms & Conditions of Xinjiang Tour

Please read the document carefully before you book your tour with XinjiangTour.Org. By registering and joining a XinjiangTour’s tour itinerary, you are agreeing to these Terms and Conditions, govern the relationship between you and XinjiangTour.Org. These Terms and Conditions affect your rights and designate the governing law and forum for the resolution of any and all disputes.

1. Reservation

Reservation will be made when you make decision to book a tour with XinjiangTour.Org, with agreeing with the tailor-made itinerary, the quotation and detailed services.

Our travel expert will send you a formal tour contract with all the agreement made between you and XinjiangTour.Org. Please fill in the Travelers List on each page and your contact information, and tell your health Status. Then please scan it or take photos of it and email signed tour contract to our company, and make sure we receive it.

The tour contract will be effective and valid when the two items are fulfilled: our company received the contract which you have signed and the deposit you have paid.

Operation team of XinjiangTour.Org will start to make reservation, basing on the final tour itinerary which you agreed with us.

2. Payment

Payment can be made by PayPal (amounts under $1,000USD), credit card bank authorization (amounts over $1,000USD), wire transfer (bank transfer), Western Union and cash. Except cash payment, a service charge (by your bank) or processing charge may apply.

A detailed payment instruction will be sent to you via email by your travel consultant. Timely payment will be required as follows:

2.1 Deposit: 20% of the total sum of your tour cost is required to be paid required by XinjiangTour to reserve space for you. Payment of the deposit indicates you have read and accepted these Terms and Conditions. Please review and verify your tour contact your tour consultant emailed to you after we received your deposit payment. Inform us immediately if your contract appears to be incorrect or incomplete, as it may not be possible to make changes later. XinjiangTour cannot accept responsibility if we are not notified of inaccuracies within 5 days of sending out the contract. In the case of billing errors, XinjiangTour reserves the right to re-invoice you with correct pricing.

2.2 Second Deposit: 40% of total sum of your tour cost is required to be paid by 15 days prior to tour arrival date. After we receive your signed tour contract, our operating team starts to make the reservation. Usually, the reservation of hotel and vehicle within 15 days do not refund the cancellation fee.

2.3 Balance: 40% of total sum of your tour cost is required to paid on arrival day. If you do not want to bring much cash during the trip, you can pay the balance in the second deport or before you board your flight.

2.4 Full flight or train ticket fee. Flights or train arranged by us will require full payment of tickets to be reserved.

2.5 Transfer Fee: all money transfer fees charged by the bank, PayPal processing and other  fees for payment shall be at the traveler’s own expense.

2.6 Currency: Tours are quoted in US Dollars. You can pay in other currencies based its rates.

2.7 Cash: In Tibet, you can pay in USD, RMB, EUR or GBP.

2.8 Exchange Rate: in case of any appreciable variation in the CNY/Dollar/Euro exchange rate, TibetTourism reserves the right to adjust its rates.

3. Change or Modification

3.1 If clients have to change the booked trip before the tour starts, please send an email to XinjiangTour to inform the change. The change may lead to cancellation/change charges from XinjiangTour and other third-party service providers like hotels, airlines, railway companies.

3.2 During the trips, If the clients have to change the itinerary or cancel some of the services, XinjiangTour will refund the unused entrance fee and accommodation. For private tour booking, XinjiangTour will refund a part of unused transportation according to the current situation.

3.3 If a change to the confirmed itinerary or service standard is caused by uncontrollable force, such as weather, unforeseen circumstances, political upheavals, disease etc., neither party shall be held responsible, and any extra cost thus caused shall be covered by the traveler himself.

3.4 If a change to the confirmed itinerary or service standard is caused by an air or rail Transportation Company, or other factors that are beyond the control of Tour company, we shall not be held responsible for the losses thus caused.

3.5 Travelers can modify the departure date 1 month before the actual tour start if they need.

4. Cancellation & Refund Policy

All cancellations and refund requests must be sent to us in writing.

Travelers may cancel confirmed tour with payment, you will be liable to pay cancellation fees.

4.1 Cancellation fees are as follows:

More than 30 Days Prior Tour Starts: No cancellation fee, excl. the loss caused by refunding of air/train tickets. Refund your deposit within 3 days.

30 to 15 Days Prior Tour Starts: 20% of total sum of your tour cost will be charged as a service fee, hotel & vehicle charge fee, excl. the loss caused by refunding of air/train tickets. Refund you the rest of the deposit within 3 days.

14 to 7 Days Prior Tour Starts: 30% of total sum of your tour cost will be charged as a service fee, hotel & vehicle charge fee, excl. the loss caused by refunding of air/train tickets. Refund you the rest of the deposit within 3 days.

Less than 7 Days Prior Tour Starts: 50% of total sum of your tour cost will be charged as a service fee, hotel & vehicle charge fee, excl. the loss caused by refunding of air/train tickets. Refund you the rest of the deposit within 3 days.

No Show Up: 100% of sum of your tour cost.

4.2 Refund Policy: See the above section on Cancellation Charges for details on the refund policies.

5. Travel Documents

All clients are required to provide a 6-months valid passports, necessary visas and necessary certificate documents, and then are permitted to travel. Any damage caused by the false or inaccurate information tourists provided will be at travelers’ own expense, eg.: hiding occupations such as diplomats, government officers, or journalists, etc. who are not allowed to travel Tibet through a travel agency. 

At times, we assist clients out of good will with invitation documents for China tourist visa. However, XinjiangTour and our travel consultants are not liable for any assistance provided in obtaining visas or travel documents that results in failure. Client is response to obtain and verify all legal information regarding travel documents from the applicable state department.

6. Health Requirement

Client is responsible to review the itinerary and determine if they’re in a healthy state to participate in the listed activities. XinjiangTour and our travel consultants are not liable for any health complications arising from the activities listed in the itinerary. It is the responsibility of the clients to advise regarding health related matters and to determine which activities are safe given their current health. XinjiangTour reserves the right to decline any trip participant which may affect client’s health and safety, or the enjoyment of other clients.

7. Travel Insurance

This charge covers the insurance premium of Personal Travel Accident Insurance, In Chinese旅游意外伤害保险 (The right to interpret is reserved by Ping An Insurance(Group) Company of China,Ltd.) offered by Ping An Insurance(Group) Company of China,Ltd.. When the agreed insurance accident happens according to the insurance contract, Ping An Insurance (Group) Company of China,Ltd. will compensate for your corresponding loss; but the exact compensation amount and proportion cannot be ascertained before ratification by the according staff of the insurance company. We only take charge of assistance with the insurance company to research, compensate and supervise whether the compensation is properly issued or not, instead of any other responsibility and compensation except those stated in the insurance contract with the insurance company. Any controversy can only resort to the Insurance Law of the People's Republic of China and relevant laws.

The insurance only covers accidents inside China, our company does not provide insurance out of China and does not compensate any accident out of China.

Our company strongly advice travelers to purchase their own insurance as the complement of the tour insurance provided by our company.

The maximum compensation is 250,000RMB based on Personal Travel Accident Insurance, In Chinese旅游意外伤害保险 (The right to interpret is reserved by Ping An Insurance(Group)Company of China,Ltd.) offered by Ping An Insurance(Group)Company of China,Ltd.

For Chinese Citizen, The maximum compensation is 100,000RMB based on Personal Travel Accident Insurance, In Chinese旅游意外伤害保险 (The right to interpret is reserved by Ping An Insurance(Group)Company of China,Ltd.) offered by Ping An Insurance(Group)Company of China,Ltd.

8. Responsibility & Liability

All members of XinjiangTour team are very pleased to serve for you. We will do our best to make your trip satisfactory during your tour. XinjiangTour.Org  provides China Xinjiang travel information and tour itinerary booking. XinjiangTour.Org  publishes tour information and services gathered at itinerary selection.

However, the responsibility of XinjiangTour team is strictly limited, XinjiangTour shall not be responsible for unreasonable and negligent acts, omissions, or failure to act of any suppliers such as those of land, air, and water transportation, sightseeing excursions, cruise/hotel accommodations, or of any third party not directly owned or operated by XinjiangTour.

XinjiangTour shall not be responsible for any loss, injury, or damage to person or property, alteration of itineraries or cancellation in part or in full, caused by climatic conditions, weather, fire, breakdown of machinery or equipment, acts of government or other authorities, wars whether or not declared, civil disturbances, strikes, riots, thefts, epidemics, quarantines, medical or customs regulations, terrorist activities, or any other actions, omissions or conditions beyond the direct control of XinjiangTour.

XinjiangTour shall not be responsible for any personal valuable items stolen or lost during your trip.

XinjiangTour shall not be responsible for your failure to comply with customs regulations.

XinjiangTour reserves the right to make changes to accommodations, tours, and flights of equal value at any time. If XinjiangTour has cancelled any tour Itinerary prior to the commencement of the tour, XinjiangTour is liable for a full refund of the money received by XinjiangTour to the client. XinjiangTour will do our best to adjust the itinerary according to your needs. However, XinjiangTour is not responsible for conflicts resulting from hotels and transportation booked solely by the client that conflict with the itinerary.

XinjiangTour reserves the right to correct pricing errors at any time, or to increase the program price in the event of cost increasing due to changes in airfares, cruise fares, currency fluctuations, park fee increases, taxes, or fuel surcharges.

XinjiangTour reserves the right to vary sightseeing order if that will enable you to visit all listed excursions. In either case, the itinerary content will be maintained to the extent possible.

9. Governing Law / Submission to Jurisdiction

This contract is governed by the laws of the People's Republic of China. All disputes related to this contract should be solved via discussion first. If the problem cannot be solved, either party can lodge a complaint to the local People's court. This contract is written in English.

10. Complaint and Contact Us

10.1 Any complaint or claim about the tour services offered on this web site, involving the negligence of any suppliers, sub-contractors outside Xinjiang, or agents in relation to any service provided to the tour participant, must be notified to XinjiangTour while on the tour, except where such time limitations are prohibited by law.
